Reimbursement of costs of counter-expertise

Based on article 7:959 BW, the legal obligation arises that the costs of the counter-expert are borne by the insurer. Insurers have also included this obligation in their policy conditions.

Insurers are therefore obliged to reimburse the reasonable costs of determining the damage, such as the costs of the counter-expert.

For companies, the insurer is also obliged to reimburse the costs of the counter-expert. However, in some cases, the insurer can cap the costs at the costs of its own loss adjuster.
